LIABILITY WAIVER
This Liability Waiver is made and entered into this day of

by and between Ell-ahvated Fitness L.L.C., hereinafter designated “Owner,” and, hereinafter designated “Member”
and if Member is a minor, Member’s parent of guardian,
It is the responsibility of the member, or parent/guardian of, to carry full and complete insurance
coverage on his/her personal property and him/herself. Members agree that they will inspect the facilities and equipment to be used, and if they believe anything is unsafe, they will immediately advise the officials of such conditions and refuse to participate. Members acknowledge that the proper use of weight training equipment, cardio equipment, and any other fitness equipment can lead to serious injury or even death. Members agree that they possess sufficient knowledge of how to perform every exercise and further agree that they will seek professional assistance if they are ever unsure of how to perform an exercise or use any equipment owned, leased, or operated by the owner. Members agree to hold the owner harmless in the event they are injured while under the supervision of any professional employed by or an independent contractor of the owner.
Member agrees to assume any and all risks involved in or arising from the Member’s use of
the Owner’s equipment or presence upon the Owner’s property and facilities including, without
limitations but not limited to, the risk of death, bodily injury, property damage, fire and explosions, the unavailability of emergency medical care, or the negligence or deliberate act of another person. Members further agree that these risks and dangers may be compounded by the action, inaction, or negligence of others including but not limited to other Members or Owners.
Member agrees to hold Owner completely harmless and not liable and releases them from all
liability whatsoever and agrees not to sue them in connection with any claim, causes of actions, injuries, damages, costs or expenses arising out of the Member’s use of Owner’s equipment, property and facilities, fire and explosions, the unavailability of emergency medical care, or the negligence or deliberate act of another person. Member expressly agrees that the foregoing release, waiver, and indemnity agreement is
intended to be as broad and inclusive as is permitted by the law of the State of Iowa and that if any portion is held invalid, it is agreed that the remaining shall continue in full legal force and effect. All members under the age of 18 are required to be accompanied by an adult unless a
parent or guardian has consented to unsupervised use of the facilities and equipment.
By execution of this document, I hereby give permission to Ell-ahvated Fitness L.L.C. to
photograph my activities in generally accessible, non-private areas of its facility, and to use such
photographs for legitimate business purposes without compensation to me.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY
AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP
SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY
WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND
MY SIGNATURE TO BE COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE
GREATEST EXTENT ALLOWED BY LAW .
